Derivatives Contract Failure From Iowa to Mexico Triggers SDNY Suit and Mediation

SDNY COURTHOUSE, Dec 18 – Iowa-based INTL FCStone Markets has sued Intercambio Mexicano de Comercio over failure to pay on an over the counter derivatives contract.        

    On December 17, U.S. District Court for the Southern District of New York  Judge Alvin K. Hellerstein held a proceeding. Inner City Press covered it. 

  Judge Hellerstein, to the point as usual, said that a key issue the jury waiver, and the contract itself. The parties had proposed another conference before him on June 29, 2022. But that is not a Friday, Judge Hellerstein’s favored day for such conferences, so it was moved to July 8.

   Talk turned to mediation. One side brought up Bob Adams, Judge Hellerstein mentioned Lawrence Kobrin, in senior status with Cahill Gordon.

He asked the parties to submit a joint letter with  a mediator name.

The case is  INTL FCStone Markets, LLC v. Intercambio Mexicano de Comercio S.A. de C.V., 18-cv-1004 (Hellerstein)
